These Terms govern the conditions and procedures for using NUIRUMI (the "Service"), a mobile application for photographing plush toys and creating clothing patterns, provided by Holoceive Inc. (the "Company"), as well as the rights, obligations and responsibilities between the Company and users.
Article 2 (Definitions)
The terms used in these Terms are defined as follows.
Service: the plush-recognition camera and pattern-making mobile application provided by the Company, and all related services.
User: any member or non-member who uses the Service under these Terms.
Member: a user who signs in with a social account.
Non-member: a user who uses part of the Service without signing in.
Parts: augmented-reality decorations displayed over a plush toy.
Pattern: plush clothing pattern data created by a user in the Craft screen.
Pattern code: a unique string issued so a pattern can be passed to other users.
Article 3 (Effect and Amendment of the Terms)
These Terms take effect when posted within the Service or on a related screen.
The Company may amend these Terms to the extent permitted by applicable law.
When the Terms are amended, the Company will give notice at least 7 days before the effective date, stating the effective date and the reason. For changes that are unfavourable or material to users, notice will be given at least 30 days in advance.
A user who does not agree to the amended Terms may stop using the Service and request account deletion.
Article 4 (Use of the Service)
Both members and non-members may use the Service, and there is no age restriction on use.
Camera capture, wearing parts, and viewing a pattern received by code are available without signing in.
Saving patterns, issuing and sharing pattern codes, keeping received patterns, and reporting require signing in.
The Service contains no paid purchases and no paid virtual currency.
Article 5 (Registration and Account Deletion)
A user may become a member by signing in with an X, Apple or Google account.
If the user does not enter a nickname, the Company automatically assigns one.
A member may request account deletion at any time from the settings screen in the app.
On deletion, every pattern code issued by the member is deactivated and the stored pattern data and thumbnails are deleted immediately. Users who already received those patterns will see them as removed.
The pattern code value itself remains in a disabled state so that the same code cannot be reissued to another user.
If the user signs in again with the same social account after deletion, the account is reactivated. Deleted patterns and the previous nickname are not restored.
Article 6 (Provision and Modification of the Service)
The Company provides the following services.
Camera capture and recording with plush recognition
Wearing augmented-reality parts
Creating plush clothing patterns in the Craft screen
Issuing and sharing pattern codes
Sharing captured results externally
Other services planned and provided by the Company
The Company may modify the content of the Service as required for operational or technical reasons.
Article 7 (User Content and Pattern Sharing)
Rights in a pattern created by a user belong to that user.
Once a user issues a pattern code, anyone who knows the code, including users who are not signed in, can view and receive the pattern. A code works like a public link, so please consider carefully with whom you share it.
A user may turn off their pattern code or delete the pattern at any time.
A user may choose whether to be credited. If crediting is turned off, the nickname is not shown.
A user must not create or share a pattern that copies another person’s work without permission.
Article 8 (Reporting and Sanctions)
A user may report a viewed pattern for plagiarism, offensive content, or spam.
Only an account that has viewed the pattern may report it, once per account. A user cannot report their own pattern.
When reports on a single pattern reach a set threshold, that pattern is suspended automatically.
A user who disagrees with a suspension may request a review at the email address in Article 14.
A user may block a creator. Block information is stored only on that device and is not sent to the server.
Article 9 (Handling of Captures and Data)
Photos and videos taken with the camera are stored only on the user’s device and are not transmitted to the Company’s servers.
Plush recognition and part tracking are processed on the user’s device.
What the Company stores on its servers is account information, the nickname, patterns and thumbnails the user saved, and pattern view and report records.
Details of personal data handling are governed by the Privacy Policy.
Article 10 (Copyright and Use of Content)
Copyright in content provided by the Service, such as parts and app screens, belongs to the Company.
A user may share externally the results they create through the Service.
The user is responsible for any infringement of portrait rights, copyright, trademark rights or other third-party rights arising from such external sharing.
A user may not reproduce, distribute or sell content provided by the Company for commercial purposes without the Company’s prior approval.
Article 11 (Restrictions on Use)
Use of the Service may be restricted if any of the following occurs.
Interfering with the operation of the Service
Misappropriating another person’s account
Sharing patterns that copy another person’s work without permission or that are offensive
Violating applicable law or public order and morals
Other use the Company reasonably deems inappropriate
Article 12 (Suspension of the Service)
The Service may be temporarily suspended in the following cases.
System inspection, expansion or replacement
Server or network failure
Force majeure such as natural disaster
Notice will be given in advance where possible, and afterwards where unavoidable.
Article 13 (Limitation of Liability)
The Company is not responsible for the following.
Service failures caused by the user’s device environment or network
The accuracy of plush recognition and part tracking results
Disputes with third parties arising from external sharing
Disputes arising between users in the course of pattern sharing
Damage caused by the user’s intent or negligence
